Usufruct Duration and Exit: What Happens When the Contract Ends?

Understand usufruct duration, early exit and what happens at expiry. Learn why transferring a right differs from getting your initial payment back in cash.

Suppose a subscriber pays SAR 50,000 for a four-year benefit, then needs cash after one year. Can the right be transferred? At the end of the four years, is any further payment due? These are different questions, and both matter before assessing the distribution schedule.

Usufruct duration concerns the period of benefit established by the documents. Liquidity concerns converting the right into cash, including the time, price and costs involved. A short term does not guarantee immediate exit, and a long term does not establish that a buyer will be available when needed.

Separate three dates

Check when the right begins, when income is expected to start, and when the right ends. These dates may differ. If the term starts before collection begins, ask how that interval is reflected in the projected cash flows.

Identify the event that ends the arrangement: ordinary expiry, early termination or another documented circumstance. Different events can have different consequences. An answer about normal expiry should not be applied to every termination scenario.

Place these dates on one timeline alongside known cash needs. A timing gap is easier to evaluate before entering the arrangement than after committing to it.

Expiry does not automatically mean repayment

Muder’s published terms describe the usufruct subscription as payment for a benefit, not a deposit repayable at ordinary expiry. Early exit depends on another buyer, while specific termination entitlements remain subject to the relevant documents. Muder terms, Sections 18 and 19.

Examine expected receipts across the entire term and any entitlement at the end. Do not automatically add the initial subscription to final cash flows. Equally, do not treat every earlier payment as profit above an amount you assume will later be returned without a contractual basis.

Transfer permission is different from a completed sale

Permission to transfer answers a contractual question. It does not establish demand for the right or the price someone will pay. Ask about approvals, finding another participant, fees and settlement timing.

Suppose, hypothetically, someone purchases a 36-month benefit and needs cash after month twelve. Even if transfer is permitted, they should not plan a future commitment on the assumption of an immediate sale at the original price. They need to understand what happens if no buyer is available or the proposed price is lower than expected.

Where an exit process is described, distinguish submitting a request, receiving acceptance, completing the transaction and receiving cash. The first step does not establish that all the others will follow.

Read the ending before the distribution schedule

Request written clarification of amounts due at normal expiry, what changes upon early termination, and how outstanding rent or unsettled expenses are handled.

If an answer refers to another document, read that document alongside the contract. Check version dates so that the assessment does not combine conditions from different editions.

Before subscribing through Muder, read the terms and conditions together with the opportunity documents. Understanding the end of the arrangement belongs at the beginning of the decision.
